China issues Outline for Building a Powerful Intellectual Property Country with 115 points in 7 categories

The China National Intellectual Property Administration (CNIPA中国国家知识产权局) published the Outline for Building a Powerful Intellectual Property Country and the Annual Promotion Plan for the Implementation of the 14th Five-Year Plan (2021-2125) (知识产权强国建设纲要和“十四五”规划实施年度推进计划) on January 4, 2022. The Outline consists of 115 points in 7 categories, clarifying the key tasks and work measures on IPR in 2021-2022. JW Insights reported.

The categories include improving the intellectual property system, the protection of intellectual property rights, the operating mechanism of the intellectual property market, and the public services for intellectual property, creating a good humanistic and social environment for intellectual property rights, deepening the participation in global intellectual property governance, and strengthening organizational guarantees.

Of particular meaning are plans to revise the Anti-Monopoly Law of the People’s Republic of China, Detailed Rules for the Implementation of the Patent Law of the People’s Republic of China, Provisions on Regulating Patent Application Behavior, and Provisions on the Protection of Trade Secrets. For copyright, the outline prescribed to amend the Regulations on the Implementation of the Copyright Law of the People’s Republic of China, Regulations on Copyright Collective Management, Trial Measures for Voluntary Registration of Works, Measures for the Registration of Computer Software Copyrights, Measures for the Implementation of Copyright Administrative Penalties, and advance the legislation of the Regulations on Copyright Protection of Folklore and Art Works.

The Supreme People’s Court will formulate the Interpretation on Several Issues Concerning the Application of Law on Punitive Compensation for Civil Infringement of Intellectual Property Rights and the Provisions on Several Issues Concerning the Application of Law in the Trial of Drug Patent Linkage Disputes as well as the Interpretation on Several Issues Concerning the Application of the Anti-Unfair Competition Law of the People’s Republic of China, among the measures for enhancing the protection of intellectual property rights.

The Outline also said that China is accelerating the accession to the Hague Agreement Concerning the International Registration of Industrial Designs.

Besides the recently signed Regional Comprehensive Economic Partnership Agreement (RCEP), China will also promote the negotiation of the IP issues in free trade agreements between China, Japan and South Korea, China-Norway, and China-Israel, and actively promote the entrance of the Comprehensive and Progressive Trans-Pacific Partnership (CPTPP).
