The four Chinese companies related to solar cells and modules responded on their being listed in the US preliminary determinations in the circumvention inquiries, saying they are in normal operations and have not been affected by the US decision, reported JW Insights on December 5.

US Department of Commerce released on December 2 its preliminary determinations that the four Chinese companies, namely BYD Hong Kong, Canadian Solar(阿特斯), Trina Solar(天合光能), and Vina Solar(越南光伏科技有限公司), are attempting to bypass US duties by doing minor processing in one of the Southeast Asian countries before shipping to the United States on December 2.

Such actions amount to an effort to evade the existing anti-dumping duty (AD) and countervailing duty (CVD) orders on solar cells and modules from China, which undermine American industries, added the department.

The department also said that these findings are preliminary and do not constitute a ban on imports from those countries, and those companies can certify that they are not circumventing the AD/CVD orders.

It’s reported that BYD and Trina Solar said that this is only a preliminary ruling, with no impact on the company and regular customs clearance so far.

Longji Green Energy(隆基绿能), the parent company of Vina Solar, said the firm has sufficient methods to deal with potential issues during the two-year exemption period, and it will cooperate with the investigation of the US.
